Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and ResWiz governing your access to and use of https://reswiz.ai and the related software, features, content, and services (collectively, the “Service”).

By creating an account, selecting an acceptance control, purchasing a plan, or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service. If you use the Service for an organization, you represent that you have authority to bind it, and “you” includes that organization.

You must be at least 18 years old and legally able to enter this agreement. Access may require an invitation. An invitation is personal unless we expressly permit transfer.

Provide accurate account information and keep it current. You are responsible for activity under your account and for maintaining the confidentiality of your credentials. Do not share an account or allow another person to impersonate you. Notify support@theresumewizard.ai promptly if you suspect unauthorized access. We may require identity or account verification to protect the Service or process a request.

ResWiz is a job-search workspace that helps users organize career information and applications, import job postings, generate and edit application materials, prepare for interviews, draft communications, and track related work. Features may use artificial intelligence and third-party services.

We may add, change, limit, suspend, or discontinue features. We will provide reasonable notice when a material change negatively affects a paid plan, unless an urgent security, legal, or infrastructure issue makes advance notice impractical. Beta or preview features may be less reliable and may change or end without notice.

Plans and usage

Plans may include limits on application packets, generations, revisions, messages, or other features. Current allowances are shown before purchase or in account settings. Unless a plan says otherwise, monthly allowances reset each calendar month, do not roll over, have no cash value, and cannot be transferred. Failed operations may be restored or excluded from usage at our discretion or as stated in the product.

Automatic renewal

If you purchase a recurring plan, it automatically renews at the billing interval and price disclosed at checkout until canceled. You authorize Stripe, acting as our payment processor, to charge the payment method associated with your account for each renewal, plus applicable taxes. Your checkout screen controls if its price, currency, interval, or promotional terms conflict with general marketing copy.

Cancellation and plan changes

You may cancel a paid subscription through the billing portal available in account settings or by contacting support@theresumewizard.ai. Cancellation takes effect at the end of the current paid billing period unless applicable law or the checkout terms require otherwise. You retain paid access through that date. Deleting the app, stopping use, or deleting content does not by itself cancel a subscription.

Plan upgrades may take effect immediately and may be prorated by Stripe. Downgrades ordinarily take effect at the next renewal. If a downgrade reduces limits, some features may become unavailable, but we will not intentionally delete stored career content solely because of the downgrade.

Refunds and payment failures

Except where required by law or expressly stated at checkout, payments are non-refundable and we do not provide credits for partial periods or unused allowances. Contact us promptly if you believe a charge is incorrect. If payment fails, we may retry the charge, ask you to update the payment method, limit paid features, or return the account to a free tier. We may change future pricing with advance notice required by law; the new price applies no earlier than the next renewal after the notice period.

“Your Content” means information and material you upload, enter, connect, or create through the Service, including career history, files, job information, notes, prompts, and edited outputs. As between you and ResWiz, you retain your ownership rights in Your Content.

You grant us a worldwide, non-exclusive, limited license to host, copy, process, transmit, format, display to you, and create requested transformations of Your Content only as reasonably necessary to provide, secure, support, and improve the Service, comply with law, and enforce these Terms. This license includes permission to send necessary content to the service providers described in our Privacy Policy. It ends when the content is deleted, except for limited backups, records required by law, and information already de-identified.

You represent that you have the rights and permissions necessary to provide Your Content and direct us to process it. Do not upload confidential employer material, trade secrets, personal information about another person, or copyrighted material unless you are authorized to use it for this purpose. You remain responsible for the accuracy, lawfulness, and final use of Your Content.

Subject to your compliance with these Terms and to any rights held by others, you may use output generated for you by the Service for your personal or professional job search. To the extent we acquire rights in that output, we assign those rights to you upon generation. This does not transfer our software, templates, brands, design system, prompts, evaluation methods, or other Service materials.

AI systems may produce similar output for different users, and generated output may not qualify for copyright or other legal protection. We do not guarantee that output is unique, non-infringing, accurate, or appropriate for a particular use.

You may not use the Service to:

• violate law, regulation, court order, or another person’s rights;
• fabricate employment, education, credentials, achievements, references, or other material qualifications, or impersonate another person;
• upload confidential employer information, personal data, malware, or content you are not authorized to process;
• harass, discriminate against, threaten, deceive, defame, or exploit anyone;
• send spam, phishing, deceptive outreach, or communications that violate consent, marketing, or anti-spam requirements;
• bypass access controls, rate limits, usage limits, subscription restrictions, or security measures;
• probe, scan, attack, disrupt, overload, reverse engineer, or introduce malicious code into the Service, except where applicable law expressly permits limited reverse engineering despite this restriction;
• scrape, crawl, harvest, or access the Service through automated means except through an interface we expressly authorize;
• resell, sublicense, rent, or provide the Service as a bureau or competing product without written permission; or
• use output or data from the Service to train a competing model or product, or to make high-impact employment decisions about another person.

We may investigate suspected violations and remove content, restrict features, suspend accounts, preserve evidence, or contact authorities where reasonably necessary and lawful. We will consider context and proportionality when practical.

The Service may connect to or depend on third parties such as job sites, company websites, Google, Microsoft, Stripe, OpenAI, and file or analytics providers. Their products, content, availability, and policies are controlled by them. Your use of a third-party service may be subject to separate terms.

Job postings and company information can change, expire, or be inaccurate. A link or imported record does not mean that we endorse an employer, verify an opportunity, or guarantee that an application will be accepted. Confirm important information at the original source and use appropriate caution with recruiters and job offers.

The Service assists with drafting and organization. It does not provide legal, financial, immigration, recruiting, human-resources, or other professional advice. It is not an employer, staffing agency, job board, background-check provider, or consumer reporting agency.

AI-generated and automated analysis may be inaccurate, incomplete, outdated, biased, repetitive, or unsuitable. You must review and edit all material before use, verify every factual claim, protect confidential information, and decide whether a suggestion reflects your real experience. Do not submit invented qualifications or statements you cannot support.

“ATS-ready,” job-match scores, recommendations, and similar labels describe product design goals or automated estimates—not a certification or promise. We do not guarantee compatibility with any applicant-tracking system, recruiter response, interview, offer, salary, employment outcome, or time to hire. Hiring decisions are made by third parties outside our control.

The Service, including its software, interface, visual design, templates, text, workflows, brands, logos, prompts, and underlying technology, is owned by us or our licensors and protected by law. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Service for your own lawful job-search purposes during your account term.

If you provide suggestions or feedback, you grant us a perpetual, worldwide, royalty-free right to use it without restriction or compensation, provided we do not publicly identify you as the source without permission.

Our Privacy Policy explains how we handle personal information, including information processed by AI and connected services. Our Cookie Policy explains browser storage and optional analytics choices. These policies are incorporated into these Terms to the extent applicable.

You may stop using the Service at any time. Cancel any paid subscription separately through the billing portal or support. You may request account deletion by emailing support@theresumewizard.ai. Before deletion, download any material you wish to keep.

We may suspend or terminate access if you materially or repeatedly violate these Terms, create security or legal risk, fail to pay, abuse the Service, or if continued operation becomes unlawful. When practical, we will provide notice and a reasonable opportunity to cure or export content, but we may act immediately for serious abuse, fraud, security threats, or legal requirements.

On termination, your right to use the Service ends. Provisions that by their nature should survive—including ownership, payment obligations, disclaimers, liability limits, dispute terms, and recordkeeping rights—will survive. Personal information is handled under the Privacy Policy.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components; that content will be preserved without loss; or that output will meet your needs. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESWIZ AND ITS OPERATORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES, LOST DATA, BUSINESS INTERRUPTION, REPUTATIONAL HARM, OR THE CONDUCT OF EMPLOYERS OR OTHER THIRD PARTIES, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US$100.

These limits apply regardless of the theory of liability and are an essential basis of the agreement. They do not limit liability that cannot lawfully be limited, including liability for fraud, willful misconduct, or personal injury caused by negligence where applicable law prohibits limitation. Mandatory consumer rights remain unaffected.

To the extent permitted by law, you will defend, indemnify, and hold harmless ResWiz and its operators from third-party claims, damages, and reasonable costs arising from Your Content, your unlawful or unauthorized use of the Service, or your material violation of these Terms. This obligation does not apply to the extent a claim results from our own unlawful conduct. We will provide reasonable notice and allow you to control the defense, subject to our right to participate and approve a settlement that imposes obligations on us.

Before filing a formal claim, please email support@theresumewizard.ai with a description of the dispute and requested resolution. The parties will attempt in good faith to resolve it informally for 30 days. This does not prevent either party from seeking urgent injunctive relief or using a small-claims process where eligible.

These Terms do not select a forum or waive rights where doing so would be unfair or unlawful. A dispute may be brought in a court that has lawful jurisdiction over the parties and subject matter. The law that court is required to apply will govern, without limiting non-waivable consumer protections available where you live.

We may update these Terms to reflect changes in the Service, business, or law. We will post the revised Terms with a new effective date. For material changes, we will provide reasonable notice and request renewed acceptance when required. Changes do not apply retroactively unless law permits and the notice clearly says so. Continued use after the effective date constitutes acceptance where lawful.

These Terms and incorporated policies are the entire agreement about the Service and supersede prior discussions on that subject. If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or sale of the Service. No third party is a beneficiary unless these Terms expressly say otherwise.

Notices may be provided through the Service, to the email associated with your account, or on the website. Electronic notices and acceptances satisfy written-form requirements where permitted. Headings are for convenience only.
